- These terms of use (the “Terms”) apply between you and applicable Viaplay Group Entity. “Viaplay Group Entity” or “Viaplay” shall mean either Viaplay Group AB (publ), reg. no. 559124-6847 (“Viaplay Group AB”), or any of the companies owned in whole or in part, directly or indirectly, by Viaplay Group AB, including Nordic Entertainment Technology AB ("NENT Tech"). Applicable Viaplay Group Entity, including NENT Tech, provide its metadata and other services to you subject to these Terms, should you not consent to these Terms you are not entitled to use the metadata and other services

- If you have created an account at https://press.viaplaygroup.se/, https://presse.viaplaygroup.no/, https://press.viaplaygroup.dk/ or https://press.viaplaygroup.fi/ or you use other Viaplay Group Entity metadata, or use software provided by any Viaplay Group Entity (collectively “Viaplay Services”) stating that its usage his subject to these Terms, by using any of the Viaplay Services you unconditionally accept these Terms. Please read these Terms carefully. In addition, when you use any current or future Viaplay Services, you may also be subject to additional terms and conditions, guidelines and agreements (“Additional Terms”) applicable to that Viaplay Service and as informed. If these Additional Terms are inconsistent with these Terms, the Terms will prevail.

Additional Terms

- The following Additional Terms, the terms and conditions of Clipsource, apply to your usage of the Viaplay Service providing metadata from any Viaplay Group Entity. By using this Viaplay Service you unconditionally accept the terms and conditions of Clipsource.

Copyright

- Any and all content provided through the Clipsource Viaplay Service or made available through any Viaplay Service, such as metadata text, graphics, logos, button icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of either Viaplay Group AB, applicable Viaplay Group Entity or a third party content provider and is protected by copyright laws. The compilation of all content included in or made available through any Viaplay Service is the exclusive property either of Viaplay Group AB and/or applicable Viaplay Group Entity, or rightfully licensed by Viaplay Group AB and/or applicable Viaplay Group Entity, and respectively protected by copyright laws.

License and Site Access

- Subject to your unconditional acceptance of these Terms, Viaplay Group AB and/or applicable Viaplay Group Entity or the applicable third party content provider grants you a limited (including limited in time and territory), non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Viaplay Service, including digital content available through a Viaplay Service, and not to download (other than page caching) or modify the Viaplay Service, or any portion of it. The license above to use the Viaplay Service or its contents does not include any resale or commercial use of any Viaplay Service or its contents or any derivative use of the Viaplay Service or its contents. All licenses are non-exclusive and all rights not expressly granted to you in these Terms or any Additional Terms are reserved and retained by Viaplay or its licensors, suppliers, publishers, rightsholders, or any other content provider. You will further use any Viaplay Service in compliance with all applicable laws.

- Viaplay reserves the right (but not the obligation) to remove or edit any content provided through a Viaplay Service.

Your Account

- If you use any Viaplay Service, provided by Viaplay or third Party, you are responsible for maintaining the confidentiality of log-in information and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Viaplay reserves the right to immediately refuse service, terminate accounts, or remove or edit content in its sole discretion and without notifying you. Further, you may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of your account.

Disclaimer of Warranties and Limitation of Liability

- THE VIAPLAY SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE VIAPLAY SERVICES ARE PROVIDED BY VIAPLAY ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIAPLAY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE VIAPLAY SERVICES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE VIAPLAY SERVICES. YOU EXPRESSLY AGREE THAT YOUR USE OF THE VIAPLAY SERVICES IS AT YOUR SOLE RISK. VIAPLAY RESERVES THE RIGHT TO WITHDRAW ANY VIAPLAY SERVICE OR DELETE ANY INFORMATION FROM THE VIAPLAY SERVICES AT ANY TIME IN ITS DISCRETION.

- TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, Viaplay DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. VIAPLAY DOES NOT WARRANT THAT THE VIAPLAY SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE VIAPLAY SERVICES, ITS SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM Viaplay ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. VIAPLAY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY VIAPLAY SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY Viaplay SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, AND INDIRECT DAMAGES.

Applicable Law & Disputes

- By using any Viaplay Service, you agree that the laws of Sweden, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and Viaplay.

- Any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or validity thereof shall be finally settled by arbitration in accordance with the Rules of the Arbitration Institute of the Stockholm Chamber of Commerce. The place of arbitration shall be Stockholm. The arbitral tribunal shall be composed of three (3) arbitrators. The language of arbitration shall be Swedish.

Site Policies, Modification, and Severability

- Please review our other policies. These policies also govern your use of Viaplay Services. We reserve the right to make changes to our site, policies, these Terms at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
